The creation or modification of an Installation Classified for Environmental protection (ICPE) is subject to an administrative authorisation before it can start operation.
Depending on the type of procedure applicable to the installation (subject to declaration or to authorisation), in order to obtain the authorisation, the operator must register an ICPE file or an operating license application with the Prefecture. Both types of files are used to show the company's level of control of the risks it faces (accidental and chronic risks).
On request from the Regional Authority for Industry, Research and the Environment (DRIRE), the operating license application can be subject to a critical analysis by a third-party expert.
Classified installations are listed in appendix 1 of the Decree dated 20 May 1953 (Nomenclature), now included in the French Environmental Code.
The contents of the declaration and authorisation files are specified in the French Environmental Code (articles R.512-2 et seq.).
When justified by the particular importance of the hazards or inconvenience of the installation, the Prefect can require the production of a critical analysis of items in the operating license application which merit special inspections, these being carried out by an outside expert organisation selected by agreement with the administration.
